McDowell magistrate indictment dismissed

WELCH (AP) — A judge has dismissed an indictment charging a McDowell County magistrate with falsification of a court document.

Mercer County Circuit Court Judge Omar Aboulhosn’s order says the state can’t prove that Magistrate Steve L. Cox committed a crime.

Cox was accused of adding a hand-written note to a court note.

Aboulhosn’s order also says Cox did his duty as a magistrate when he denied petitions by Kevin B. Wade. Wade’s petitions had sought personal safety orders against various law enforcement officers of the county.

The Bluefield Daily Telegraph reports that Aboulhosn issued the order Thursday. He was a member of a three-judge panel appointed by the West Virginia Supreme Court to hear the case.
